Collaborative Process
Discover Artful Solutions, Thoughtful GuidanceCollaborative law is an out of court process designed to help parties reach a settlement.
Two Collaborative Lawyers, accredited as collaborative practitioners, represent each party and both parties sign a Participation Agreement at the outset. This is an agreement that reflects everyone’s commitment to negotiate and communicate respectfully without going to court, and to provide full disclosure of all important information. If one party decides to terminate process, the collaborative counsel of that party can no longer represent them. This ‘disqualification clause’ keeps everyone fully committed to the success of the process.
The parties may jointly retain other collaborative professionals, a Financial Professional and/or a Family Professional, who are also trained in the collaborative process. They act as neutral experts and their fees are split between the parties.
The Collaborative Process ensures an amicable, confidential negotiation process through a series of ‘collaborative’ meetings, which are scheduled at the convenience of the parties, rather than dictated by the parties.
I have 30 years’ experience helping clients move beyond separation towards a better life. It can be a daunting time. Apart from questions about the law, clients ask: Where do I start? Will my kids adjust? Where will I live? What will my finances look like? How can I negotiate with my spouse when we are not on great terms? When will I be divorced? How long will this all take? How much will it cost?
