Both parties jointly retain a mediator who engages the parties in a discussion about the important issues and facilitates the negotiation process in order to reach a mutually satisfactory settlement.
The mediator is a lawyer or an expert in a particular field such as a social worker or a financial professional. The parties may attend mediation with or without lawyers, although each party is required to obtain independent legal advice at the end of the mediation process, since the mediator does not provide legal advice.
